NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE OR MEMBERSHIP WITH PLUME DESIGN, INC. DOES NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility: This sweepstakes is open only to individuals who are above the age of 18, live in the United States and have an Instagram account. Plume Design, Inc. (“Plume”) is the Sponsor of the sweepstakes.
2. Agreement to Rules: By entering into the sweepstakes, each participant (“Participant” or “You”) agrees to be bound by these rules (the “Rules”), and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Plume as final and binding as it relates to this sweepstakes.
3. How to Enter: To enter the sweepstakes, You must: (1) Follow @myplume on Instagram; (2) [Like this photo]; and (3) Tag at least 3 friends or family members in the comments section who need to step up their password game on World Password Day (May 5th) and use the hashtag #myplumeSTAKES (4) Have the tagged friends and family also follow @myplume. Each additional friend or family member tagged after the first 3 is an additional entry, with a maximum of 10 entries per Participant per day. This sweepstakes is only available on Instagram. To be eligible, each entry must fulfill all requirements, as specified in the Rules. Entries that are incomplete or do not adhere to the Rules or specifications may be disqualified at Plume’s sole discretion. You may not enter by using multiple identities or Instagram usernames in an attempt to circumvent the Rules. If You use fraudulent methods or otherwise attempt to circumvent the Rules, your submission may be removed from eligibility at Plume’s sole discretion. No purchase of Plume services or current Plume membership is required. Plume and each Participant acknowledge that this sweepstakes is in no way sponsored, endorsed, administered by, or associated with, Instagram.
4. Giveaway Period: Entries will be accepted starting on Thursday, May 5, 2022 at 9AM PT and ending Tuesday, May 10, 2022 at 11:59PM PT. All online entries must be received by 11:59 pm PT on Tuesday, May 10, 2022 to be eligible. The Winner will be announced on the @myplume Instagram account on Thursday, May 12, 2022 at 12PM PT. By participating in this sweepstakes, you hereby consent to Plume using your name, likeness, Instagram username and entry for purposes of this sweepstakes, including announcing the Winner, future promotions, advertising and trade without further compensation, unless prohibited by law.
5. Prizes: 1 Winner will be selected for this sweepstakes. The Winner will receive [up to] 5 SuperPods™ valued at $495 ($99 each) without tax and a 1 year-long HomePass® membership valued at $99. The total value of the prizes is $594. PLEASE NOTE THAT THE WINNER MAY BE REQUIRED TO PAY TAXES DUE ON ANY PRIZE VALUE OVER $600. The specifics of the prize shall be solely determined by Plume. No cash or other prize substitution is permitted. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. Plume shall be responsible for shipping the prize to the Winner and the costs associated with such shipment. No substitution, transfer or assignment of the prize to others is permitted. Acceptance of any prize constitutes the express permission for Plume to use Winner’s name, likeness, Instagram username and entry for purposes of future promotions, advertising and trade without further compensation, unless prohibited by law.
6. Odds: The odds of winning depend on the number of eligible entries received.
7. Winner Selection and Notification: Winner will be selected at random by a third party service acting on Plume’s behalf. The Winner will be announced on the @myplume Instagram account on Thursday, May 12, 2022 at 12PM PT. The Winner shall have 3 days to claim the prize by direct messaging @myplume on Instagram or by emailing Plume at [email protected] using the subject line: “Instagram Giveaway Winner.” Plume shall have no liability for Winner’s failure to receive notices, for any reason, including spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information, or their inability to use or access Instagram. If Winner cannot be contacted, is ineligible, fails to claim the prize within three (3) days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected by Plume through a third party service acting on Plume’s behalf (each at Plume’s sole discretion). Receipt by Winner of the prize offered in this giveaway is conditioned upon compliance with all federal, state, and local laws and regulations. ANY VIOLATION OF ANY OF THE RULES BY WINNER, AS DETERMINED IN PLUME’S SOLE DISCRETION, WILL RESULT IN WINNER’S DISQUALIFICATION, AND ALL PRIVILEGES WILL BE IMMEDIATELY TERMINATED.
8. Rights Granted by You: By entering this sweepstakes, You understand and agree that Plume and anyone acting on behalf of Plume and Plume licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, Instagram username, portrait, picture, voice, likeness, image, statements about the sweepstakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any compensation, notice, review, or consent (other than in the Rules). By entering this sweepstakes, You represent and warrant that your entry does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at Plume’s sole discretion. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Plume from and against any suit, proceeding, claims, liability, loss, damage, costs or expense which Plume may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
9. Terms & Conditions: Plume reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the sweepstakes at any time for any reason. Plume may also cancel, terminate, modify or suspend the sweepstakes if a virus, bug, non-authorized human intervention, fraud, or other cause beyond Plume’s control, corrupt or affect the administration, security, fairness, or proper conduct of the sweepstakes. In such case, Plume may select the Winner from all eligible entries received prior to and/or after any such event. Plume reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the sweepstakes or website or violates the Rules. Plume has the right, in its sole discretion, to maintain the integrity of the sweepstakes, to void entries for any reason, including, but not limited to: the use of bots, macros, scripts, or other technical means for entering. Any attempt by any Participant to deliberately damage any website or undermine the legitimate operation of the sweepstakes may be a violation of criminal and civil laws. Should such attempt be made, Plume reserves the right to seek damages to the fullest extent permitted by law.
10. Limitation of Liability: By entering, You agree to release and hold harmless Instagram and Plume and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) Your participation in the sweepstakes and/or Your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of Instagram and any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the sweepstakes; (v) electronic or human error in the administration of the sweepstakes or the processing of entries.
11. Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF CALIFORNIA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this sweepstakes, You agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Santa Clara, California having jurisdiction. Further, in any such dispute, under no circumstances shall Participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Participant’s actual out-of-pocket expenses (i.e. costs associated with entering this sweepstakes). Participant further waives all rights to have damages multiplied or increased.
12. Privacy Policy: Information submitted with each entry and information submitted after being selected as a Winner is subject to the Privacy Policy stated on Plume’s website.
13. Instagram Affiliation: This sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram. You are providing your information to Plume Design, Inc. and not to Instagram. By participating in this sweepstakes, You agree to a complete release of Instagram from any claims. 14. By participating in this sweepstakes you, the Participant, have affirmatively reviewed, accepted, and agreed to all of the Rules, and represent and warrant that you are over the age of 18 and live in the United States.
